The copyrights claim has become one of the biggest issues for the artists around the globe and ignites a serious friction within the music industry. One such incident happened to the Indonesian singer Agnez Mo and she has been instructed to pay a fine of 1.5 billion IDR by the Commercial Court for performing a song of the composer Ari Bias without permission. It is reported that she had performed this song at three different concerts which are, 

  • HW Super Club Surabaya for IDR 500 million – May 25, 2023

  • H-Club Jakarta for IDR 500 million – May 26, 2023

  • HW Superclub Bandung for IDR 500 million – May 27, 2023

This was confirmed by the direct visit done by Ari Bias with the National Collective Management Institute (LMKN), as the copyright holder on March 28, 2024. All these were mentioned in the verdict clearly. Meanwhile, LMKN has said that they haven’t given any permission to perform the song at any stages at that time. This led to the legal battle of the rights by Ari Bias for his song ‘Bilang Saja’. Further, the verdict unfurls the incident of Ari who tried to contact the manager of Agnez via whatsapp message to cross check the permission clearance of her for the song. He has been sending the letters consistently to the manager but received no reply from that end. This led to the issue of a warning letter to Agnez on April 19,2024 by Ari and a public summon was sent to both the parties on May 2,2024.

“The violation is regulated in Article 9 paragraph (2) of Law Number 28 of 2014 concerning Copyright, which states: every person who exercises economic rights referred to in paragraph (1) is required to obtain permission from the Creator or Copyright holder” – the verdict

“Any person who without the permission of the Creator or Copyright Holder is prohibited from duplicating and/or using the Creation commercially” – Article 9 paragraph (3) of Law number 28 of 2014.
